    In 25 years in international trade and customs law, representing U.S. companies with plants in Mexico, I must have seen every type of problem that a company might face. Lawyers deal in problems. However, my approach, is to help you avoid problems by anticipating and addressing the legal issues that may arise in cross border operations before they become problems.

    I am positive about the advantages of operating maquiladora plants in Mexico. I have many clients that have operated in almost every major city in Mexico who have benefited from the combination of lower labor costs and favorable customs treatment afforded to products manufactured in Mexico under the maquiladora program. However, most of these companies realized the importance of anticipating and planning for the various legal issues that arise when establishing a plant in Mexico.

 

Legal issues

    The single most important legal area that a U.S. company operating in Mexico must deal with is U.S. Customs compliance.  Mexican customs is also a concern, but tends to be less of a problem.  Goods coming into Mexico from the United States under the maquiladora or PITEX programs are except from Mexican customs duties as long as they are re-exported within a certain time...
