24 Hour Notice

      Effective Dec. 2, 2002 , Vessel Cargo Declarations must be electronically filed with the Customs Service not less than 24 hours in advance of vessel lading at a foreign port for shipment to the United States .

      The declaration requires specific data elements including a detailed description of the merchandise or a six digit HTS classification number. Failure to provide this information on a timely basis may subject the carrier or the NVOCC to penalties. More importantly, the failure to provide timely information may result in the delayed release or exclusion of merchandise on the vessel. While the program began Dec. 2, 2002 , enforcement actions are delayed until Feb. 1, 2003 .

Analysis

      On Oct. 31, 2002 , the Customs Service issued a Final Rule requiring the presentation of a detailed and accurate vessel Cargo Declaration not less than 24 hours in advance of lading aboard the vessel at a foreign port for transport to the United States .
